Acceptance of the general terms and conditions of sale

It is mandatory that the customer takes note of the present terms and conditions of sale before placing their order. The present general terms and conditions of sale govern the contractual relationship between La Maison du Cristal and the customer. These conditions will supersede all other conditions appearing in any other document, except under specific written exemption from our side. The present general terms and conditions of sale can be modified at any time by La Maison du Cristal, without notice. However, the applicable conditions will be those in force on the site at the time of the confirmation of the order.

 

Price and payment

Prices are expressed in Euros and include tax. The prices of the products indicated on the site do not include delivery costs, though the price indicated during confirmation of the final order is the full price the customer has to pay. This full price covers the price of the products, the handling charges, packing, the delivery charges and insurance, and VAT for France and other countries of the EEC. La Maison du Cristal reserves the right to modify prices at any time, but the products or services will be invoiced on the basis of the tariff in force at the time of placing the order, subject to availability. The price is payable on the day the order is confirmed.

Please note we reserve the right to confirm payment and delivery addresses and as part of our quality controls and security checks we sometimes ask customers to email a proof of address. This is only done occasionally and we apologise for any inconvenience, but it is necessary to deter invalid orders.

 

Delay or non-payment

If the customer fails to pay any amount which is due to La Maison du Cristal, we reserve the right, with or without notice, to suspend any delivery to the customer, until payment of all sums due.

In the event of further course of action, the customer will cover all expenses engaged by La Maison du Cristal for the recovery of the sums due. Any delay of payment automatically incurs the legal liability of late payment interest corresponding to one and half times the legal rate of interest.

 

Ownership clause

In accordance with the provisions of the law of May 12, 1980, the ordered products remain the property of La Maison du Cristal until full payment by the customer. In the event the customer fails to meet their obligations, whatever the cause, La Maison du Cristal has the right to require the immediate restitution of the products at the expense and risk of the customer. This provision does not relieve the customer of the risks of loss and deterioration of the sold goods once the goods leave the warehouse, nor of protecting the goods from other damage.

 

Availability clause

If La Maison du Cristal becomes aware, after an order has been placed, that the ordered articles are not available any more, or for legal reasons cannot be delivered any more, La Maison du Cristal reserves the right to propose an article of equivalent quality and price, or the immediately termination in full of the contract without further indemnity. Any amounts already paid will be immediately refunded to the customer in the event of cancellation of the contract.

 

Right of cancellation, return and exchange

It is the responsibility of the customer to inspect the parcels received in the presence of the deliveryman and to notify any anomaly on the delivery form of the transportation company, and also to the La Maison du Cristal, within two days. If such notification on the delivery form presented to customer is not done, then it is assumed the delivery is accepted by the customer and no further recourse is possible. If the goods are not received the customer is requested to inform us within a 4 week deadline after having placed their order.

The customer has, according to Article L 121-20 of the French consumer code, a deadline of fifteen days in which to exert their right of cancellation without having to pay any penalties, except for the expenses of returning the goods which remains with the customer. This deadline begins from the day of reception of the products by the customer.

Any return must be pre-notified to La Maison du Cristal. This can be done on www.la-maison-du-cristal.fr, in the heading “History and details of orders” of “My Account”. It is enough to tick the product, indicate the quantities to be returned, the reason for the return and to validate by clicking on “Make a return”. The request for return will be confirmed by return of mail, along with the methods to be followed; namely the printing of the return label, as well as the postal address where to return the products.

In all the cases, the return is carried out under the risk of the customer. Moreover, it will be up to the customer to preserve any proof of return. The returned products must be returned in their original packaging and in their entirety. The products must be intact, in a perfect state of resale, in a state of perfect cleanliness, and must not have been used nor to have undergone any deterioration. Any product damaged, incomplete, or whose original packaging is damaged, will neither be refunded nor exchanged. On exercising the right of cancellation, the customer receives a credit for a forthcoming order equal to the value of the products returned. The customer can instead request a refund of the amount.

 

Delivery

The delivery of orders is carried out by third-parties independent of La Maison du Cristal and within the schedule published by these third-parties. La Maison du Cristal cannot be held responsible for delivery delays due to disturbances, interruptions or errors made by the delivery companies. The products are delivered to the address indicated by the customer on the purchase order. The customer must check the validity and correctness of this information that they provide to La Maison du Cristal. La Maison du Cristal cannot be held responsible for possible errors and any consequences in terms of delay or error of delivery. In this context, any expenses caused by re-forwarding of the order will be entirely borne by the customer.

In mainland France, the delivery will be carried out by La Poste colissimo or Chronopost depending on the customer's choice. In other countries of the EEC, the deliveries are carried out by La Poste colissimo Europe. Deliveries outside of the EEC are carried out by the international mail service or Chronopost depending on the choice of the customer. Depending on availability, an order can be delivered in several packages. For deliveries outside of mainland France, the customer commits themselves to any and all taxes due to importation of products, customs duty, value-added tax, and all other taxes due under the terms of the laws of the country where delivery is made.

For any order placed online via www.la-maison-du-cristal.fr and confirmed between Monday and Friday, except public holidays, the preparation of the order will take place within 48 hours, within the limit of available stock. An e-mail is sent to the customer when the products are sent; assuming the provided email address does not contain an error. From reception of this e-mail, the customer should allow for the delivery times of the postal services as follows. The delivery time in mainland France with Colissimo: less than or equal to 5 days, for Chronopost: less than or equal to 3 days. The delivery times indicated above are those generally published. No refund of delivery costs will be provided in the event of delivery taking longer than indicated.

In the event of unavailability of the products, La Maison du Cristal will inform the customer of the date on which the product will be again available. The customer then has the possibility of maintaining their order with these new deadlines, or of cancelling it. In case of cancellation, La Maison du Cristal commits itself to refunding the amount paid without delay or at the latest within 30 days, in accordance with the provisions of the L121-20-3 article of the consumer code.

 

Guarantees

In accordance with article 4 of the decree n°78-464 of March 24, 1978, the terms and conditions of sale cannot deprive the customer of the legal guarantee which obliges professional sellers to provide a guarantee against defective goods. This clause is applicable only following the full payment of an order.

The customer is expressly informed that La Maison du Cristal is not the manufacturer of the products presented on www.la-maison-du-cristal.fr, within the meaning of the law n°98-389 of May 19, 1998 and relating to defective product liability. Consequently, in the event of damage caused to a person or other property by a defect of the product, only the manufacture’s responsibility can be pursued by the customer, based on the product information provided on the manufacture’s packaging.

The contractual guarantee is strictly limited to the replacement of defective products. In the event of abnormal wear related to negligence or an abnormal use on behalf of the customer, the contractual guarantee is not applicable. The photographs, images, dimensions, sizes and weights appearing in our publications are for indicative purposes and are not contractual.

 

Responsibility

The products offered conform to the applicable standards in France and the French legislation in force. The responsibility of La Maison du Cristal does not cover the observance of legislation of the country where the product is delivered. It is up to the customer to check with the relevant local authorities regarding the importation and use of the products which they plan to order.

La Maison du Cristal cannot be held responsible for any consequential damages which could occur because of purchase of the products. In the same way the responsibility of La Maison du Cristal, under the obligations of the present terms and conditions of sale, does not apply in the event of a cause beyond our control as defined by the French jurisdictions.

 

Personal data

In accordance with French data-processing law and freedom of information (n° 78-17 of January 6, 1978) every visitor has a right of access, and of correction or removal of their personal data held by us, by sending an email to contact@la-maison-du-cristal.fr

Customers can also find their personal information, and make any necessary modifications or corrections, directly on the website.

 

Applicable law

Any placed order automatically carries the acceptance by the customer of these general terms and conditions of sale. These general terms and conditions of sale are covered by French law. In the event of litigation, only French Courts are qualified.
